Neutrality and Independence

Engagements are accepted only where no disqualifying relationship exists with either party or counsel. Compensation is by flat or hourly fee. Contingent arrangements are not accepted. Communications with appraisers are conducted on notice to both sides. Awards are documented such that the basis for each determination is apparent on the face of the record.

Prior engagements do not influence the analysis or determination in any matter.

Timothy Wieneke serves as an appraisal umpire and expert witness in property insurance matters. Engagements are accepted from courts, insurers, policyholders, and counsel.

Background

More than twenty five years in property and casualty claims, forensic estimating, and building consulting. Work has included field adjustment, large loss handling, scope and estimate review, causation analysis, and reconstruction of historical scopes and costs as of past dates of loss. Claims experience exceeds $20 million. Appraisal panel service has included matters with initial demands above $25 million.

Prior engagements have included a substantial volume of insurer and defense work. That history reflects how the practice developed rather than a position on the merits of any given claim. The same methods are applied in all engagements: independent review of the record, inspection where warranted, and reasoned written analysis.

Practice

Appraisal and Umpire. Service as neutral umpire on court appointment or by selection of the appraisers, and as party appointed appraiser. Limited to the amount of loss.

Expert Witness. Property claims opinions in litigation, including deposition and trial testimony. Subject areas include extent of damages, causation, scope and estimate review, constructive total loss, business interruption, and claims handling standards. Expert and umpire roles are not undertaken in the same matter.
